Radicom Research Incorporated (Company), of San Jose, California, warrants that its products are free from defects in materials and workmanship for a period of one (1) year from date of original shipment to customer. Customer is defined as the person, company, or entity that actually purchased the product from Company. All returned products must be returned under a pre-authorized Returned Material Authorization number (RMA). Each product returned for repair MUST indicate, in writing, the technical failure of the product. Company is not responsible for any product(s) returned without a pre-authorized RMA number. During this warranty period, Company will promptly repair or replace any defective equipment properly returned to the Company, transportation charges prepaid by customer, and will return such equipment, transportation prepaid to customer within the continental US and Canada. Exceptions would be special handling or shipments as requested by customer. This includes items such as Priority airfreight, international charges, etc; in which case, other terms must be pre-arranged and pre-approved by Company. Products returned for repair after the warranty period has expired i.e. "Out of Warranty Repairs", if repairable, will be repaired for a separate charge under the above transportation considerations as indicated below. All out of warranty repair units will be warranted for subsequent 90 days from the returned ship date from the Company. The above terms do not apply to units returned for repair with NPF (No Problem Found). Units returned with NPF may be subject to handling charges and all transportation costs, pre-paid by customer.

This warranty shall not apply to damage resulting from abuse, negligence, accident, loss or damage in transit. The warranty shall be voided should customer not previously authorized in writing by the Company attempts any repairs or alterations to the products. The Company makes no other warranty, expressed or implied, for its product, and disclaims any implied warranty of merchantability or fitness for a particular purpose. The customer and Company agree that the sole and exclusive remedies for breach of any warranty concerning the goods shall be repair, or replacement of defective parts upon the terms above described or, at the Company’s sole option, refund of the purchase price. The Company shall not be liable for contingent or consequential damages to persons or property and its sole liability is as set forth above. Any Action by Buyer for any alleged breach of the warranty set forth herein, shall be brought to the attention of the Company by Buyer within the warranty period but no later than 30 days after the alleged breach. THIS STATEMENT OF WARRANTY AND LIMITATION OF LIABILITY IS A COMPLETE AND EXCLUSIVE STATEMENT OF ALL WARRANTY AND LIABILITY REPRESENTATIONS OF RADICOM RESEARCH CORPORATION. It may not be varied, supplemented, qualified or interpreted by any prior dealings between the parties or by any usage of the trade or upon the face or reverse of any form, including customer purchase order that are accepted or executed by Company, to which this is attached or a part or, nor may it be modified by any agent, employee or representative of Company unless such modification or representation is made in writing and signed by a duly authorized officer of Company. |
